Wrongful Death Case Timeline

Start Your Wrongful Death Claim Before It's Too LateIt’s a natural concern we often hear from people: How long is my wrongful death claim going to last? How long does it take to get this resolved? The answer to that is a classic lawyer answer: it depends. In these types of cases, it depends on a lot of things.

It can depend on who caused the wrongful death. Who did the thing that was bad, the negligent act, or the dangerous product? Who the defendant is can impact the length of the case.

What’s the scope of the damages? Are the damages easily identified or are they harder to identify? What’s the nature of the behavior? Is it egregious behavior or is it behavior that’s merely somewhat negligent? Each one of those things can impact the length of time it takes to evaluate and move the case forward.

Is there an insurance company involved? That’s an important factor. Is it a case that has to go to trial or is it a case that can be resolved without having to file suit? That’s an important factor, as well.

Some wrongful death cases can be handled very quickly; some wrongful death cases require literally years of litigation. Your situation is your situation. What you need is somebody like us to help you understand your situation and then work with you to get to a resolution. You need someone to take care of you, your family and your loved ones who are dealing with the tragedy of wrongful death.

Give any of us a call here at Hepworth Holzer. We’re happy to help you address your wrongful death claim. We maybe can give you a better idea in your specific circumstance of how long it will take.

Wrongful Death Attorney Fees

We get this question a lot because our clients are normal everyday people; they don’t have $50,000 to drop on a wrongful death claim. There are costs associated with a wrongful death claim, but if you hire our office, we are hired on a contingency fee, meaning, unless we make a recovery for you, you don’t pay us any attorney fees. There are no attorney fees costs.

The other cost that you might have in a wrongful death case would be hiring experts, taking depositions and paying for transcription costs. Those are the biggest costs in these cases. Our firm will front those costs for you; we’ll pay them as we go, and you won’t have to incur those costs. They are a burden for a normal everyday person. Most people can’t pay that sort of thing, so one advantage of contacting our firm is that we won’t charge you for those costs upfront. We won’t charge you for them unless we make a recovery for you.

If you have any questions about pursuing a wrongful death claim – because we do pursue a number of these claims every year – please feel free to give us a call and ask us any questions you have.

Timing of Death After Traumatic Injury

We’ve addressed this issue with a number of clients before. For example, we had one case where a woman was diagnosed with cancer, and it should have been diagnosed four years earlier; or a person could be in a car accident, and they’re in a coma, and they eventually die from complications of the car accident. The question for the heirs, the people who would bring the wrongful death claim, is was it caused by the original negligence?

First of all, the statute of limitations in Idaho runs from two years from the date of death. Another question, and the biggest question in many of these cases, is was the death caused by the original negligence? For example, in the case involving a failure to diagnose cancer, the question was if they had diagnosed it when they received a CAT scan back or an MRI, would they have been able to prevent the death? That’s a question for the doctors.

We hire doctors. They advise us as to what they believe are the facts, and what they believe is true, and what the medicine shows. There’s the big question – when there’s a delay in the time between someone was negligent and someone passes away, the biggest question is whether or not the original act caused the death. If you have any questions about issues like this with wrongful death and a delay in diagnosis or a delay in the passing away of a loved one, please give our office a call. We’d be happy to talk to you.
